1. Acceptance of Terms

By accessing or using the Cardarro website, services, or marketplace (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Cardarro. If you do not agree to these Terms, you may not access or use the Platform.

Cardarro may update or modify these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Accounts

To use the Cardarro Platform, you must be at least 18 years old and capable of entering into a legally binding agreement. By creating an account or using the Platform, you represent and warrant that:

  • You are 18 years of age or older
  • You have the legal authority to enter into these Terms
  • All information you provide to Cardarro is accurate, current, and truthful

Cardarro reserves the right to refuse service, suspend accounts, or terminate access to the Platform if it believes a user does not meet these eligibility requirements.

2.1. Account Registration

To access the Platform, users must create an account. Guest checkout is not supported. When registering an account, you agree to:

  • Provide accurate and complete information
  • Maintain and update your account information as necessary
  • Use the Platform only for lawful purposes

Accounts may not be transferred, sold, or assigned to another person.

2.2. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect unauthorized access to your account, you must notify Cardarro immediately.

Cardarro is not responsible for any loss or damage resulting from unauthorized use of your account.

2.3. Account Restrictions

Users may not:

  • Create accounts using false or misleading information
  • Maintain multiple accounts for abusive, fraudulent, or manipulative purposes
  • Access the Platform after an account has been suspended or terminated

Cardarro reserves the right to suspend or permanently terminate accounts that violate these Terms.

3. Marketplace Role

Cardarro operates an online marketplace that enables users to buy and sell collectible trading cards and related products. Cardarro does not manufacture, own, or take possession of the items listed on the Platform. All items listed for sale are offered by independent sellers.

Cardarro provides the Platform, payment processing, and marketplace services that allow buyers and sellers to complete transactions. While Cardarro facilitates payments and order processing, the seller remains solely responsible for the items they list and sell, including:

  • Accuracy of item descriptions
  • Authenticity of items
  • Shipping and fulfillment
  • Compliance with applicable laws

Cardarro does not guarantee the quality, authenticity, legality, or condition of any item listed on the Platform. Transactions on the Platform occur between buyers and sellers, and Cardarro acts only as the marketplace facilitator.

3.1. Payment Facilitation

Payments made through the Platform are processed by Stripe or other payment service providers. Cardarro may collect payment from buyers on behalf of sellers and distribute funds according to the Platform's payment and payout policies.

By using the Platform, users agree to comply with the terms and policies of Stripe and any other applicable payment service providers.

3.2. Platform Authority

Cardarro reserves the right to:

  • Remove listings
  • Cancel transactions
  • Suspend or terminate accounts
  • Investigate suspicious activity

These actions may be taken when necessary to maintain the integrity and safety of the Platform.

4. Subscriptions & Billing

Certain features of the Platform, including the ability to create listings for sale, require an active paid subscription. Subscription plans provide sellers with a specific number of active listing slots that determine how many items may be listed for sale at one time.

When a listed item is sold, removed, or otherwise deactivated, the corresponding listing slot becomes available for reuse. Cardarro may update subscription plans, pricing, or listing limits from time to time.

4.1. Billing & Payment

Subscription payments are processed through Stripe or another authorized payment processor. By purchasing a subscription, you authorize Cardarro to charge your selected payment method for the applicable subscription fee. All payments are charged in U.S. dollars unless otherwise stated.

4.2. Automatic Renewal

Subscriptions automatically renew on a recurring monthly basis unless cancelled prior to the next billing cycle. By purchasing a subscription, you authorize Cardarro to automatically charge your payment method for each renewal period.

4.3. Subscription Cancellation

Users may cancel their subscription at any time through their account settings. Cancellation will take effect at the end of the current billing period. No partial refunds will be provided for unused time remaining in a billing cycle.

4.4. Failed Payments

If a subscription payment fails or is declined, Cardarro may:

  • Suspend the ability to create new listings
  • Remove or deactivate existing listings
  • Restrict account access until payment is successfully processed

5. Listings & Seller Responsibilities

Sellers may create listings on the Platform to offer trading cards and related collectible items for sale. All listings must accurately represent the item being offered. Sellers are responsible for ensuring that listing information is truthful, complete, and not misleading.

Cardarro reserves the right to remove listings that violate these Terms or that are determined to be inaccurate, misleading, or fraudulent.

5.1. Listing Accuracy

Sellers must provide accurate information when creating listings, including but not limited to:

  • The correct card name
  • The condition of the item
  • The correct item category (single card, sealed product, etc.)
  • Any relevant details that may affect the value or authenticity of the item

Listings may not contain false, misleading, or deceptive information.

5.2. Required Photographs

All listings must include original photographs of the actual item being sold. Stock images, promotional images, or photographs that do not depict the actual item being sold are not permitted. Photographs must clearly show the item so that buyers can reasonably evaluate its condition.

5.3. Graded Cards

For graded cards, sellers are encouraged to include the grading company certification number and clear images of the slab. While certification numbers are recommended for transparency, sellers remain responsible for the authenticity and accuracy of the item being listed.

5.4. Prohibited Items

The following items are not permitted on the Platform:

  • Counterfeit or fake cards
  • Proxy cards intended to imitate authentic products
  • Altered cards that are not clearly disclosed
  • Stolen property
  • Any items that violate applicable laws or intellectual property rights

Listings that violate these rules may be removed and may result in account suspension or termination.

6. Orders & Transactions

When a buyer completes a purchase on the Platform, the transaction becomes a binding agreement between the buyer and the seller. By completing a purchase, the buyer agrees to pay the listed price and any applicable taxes, shipping costs, or fees associated with the order.

Once an order has been placed, it is considered final and binding, subject only to the dispute process described in these Terms.

6.1. Seller Obligations

When an order is placed, the seller is obligated to fulfill the transaction by shipping the item described in the listing. Sellers may not cancel orders after they have been placed except in cases approved through the Platform's dispute or support process. Failure to fulfill orders may result in enforcement actions including listing removal, account restrictions, or suspension.

6.2. Buyer Obligations

Buyers agree to complete payment for items they purchase on the Platform. Buyers may not cancel a completed purchase unilaterally. If a buyer wishes to cancel an order, they must submit a cancellation request through the dispute process. Order cancellations may only occur if the seller agrees or if Cardarro determines that cancellation is appropriate under the Platform's dispute policies.

6.3. Platform Intervention

Cardarro reserves the right to review transactions and intervene when necessary to resolve disputes, investigate suspicious activity, or enforce these Terms. Cardarro may cancel transactions, issue refunds, or take enforcement actions when necessary to maintain the safety and integrity of the Platform.

7. Shipping Requirements

Sellers are responsible for properly packaging and shipping items sold through the Platform. Sellers must ship orders within 72 hours of purchase unless otherwise specified. Failure to ship within this timeframe may result in enforcement actions including order cancellation, listing removal, or account restrictions.

7.1. Tracking Requirements

For orders with a total value greater than $20, sellers must provide a valid tracking number through the Platform. Tracking information must be uploaded promptly after the shipment is sent. Orders that require tracking but do not include valid tracking information may be considered unfulfilled.

7.2. Insurance Requirements

For orders with a total value greater than $200, sellers are responsible for purchasing shipping insurance sufficient to cover the value of the item. Insurance helps protect both the buyer and seller in the event that an item is lost or damaged during shipment.

7.3. Signature Confirmation

For orders with a total value greater than $250, sellers must use a shipping method that includes signature confirmation upon delivery. This requirement helps verify delivery and protect both parties from disputes.

7.4. Packaging Responsibility

Sellers are responsible for packaging items securely to prevent damage during transit. Items damaged due to insufficient packaging may be subject to dispute or refund.

7.5. Shipping Risk Transfer

Sellers are responsible for shipping items to the buyer using a shipping method that complies with the Platform's shipping requirements.

Risk of loss or damage during transit remains with the seller until the shipment is confirmed as delivered by the shipping carrier.

Once delivery is confirmed by the carrier, responsibility for the item transfers to the buyer, subject to the buyer protection and dispute policies described in these Terms.

8. Payments & Fund Holding

All purchases made on the Platform are processed through secure third-party payment providers, including Stripe. By completing a purchase, buyers authorize Cardarro and its payment processors to charge their selected payment method for the full amount of the order, including any applicable taxes, shipping costs, or fees.

8.1. Payment Collection

Cardarro collects payment from buyers at the time an order is placed. Funds associated with an order are held by the Platform until the transaction meets the conditions required for payout to the seller.

8.2. Fund Holding

To help protect buyers and sellers, Cardarro temporarily holds seller proceeds until an order is successfully completed. An order is considered completed when:

  • The shipment is confirmed as delivered, and
  • The buyer protection period has expired without a dispute

8.3. Buyer Protection Window

After delivery confirmation, a five (5) day buyer protection window begins. During this period, buyers may open a dispute if an item:

  • Was not received
  • Was significantly different from the listing description
  • Arrived damaged

If no dispute is opened during the protection window, the order will be considered successfully completed.

8.4. Seller Payout Eligibility

Once an order has been successfully completed, the seller's proceeds become eligible for payout. Sellers may then request a payout according to the payout methods supported by the Platform. Cardarro may delay or withhold payouts when necessary to investigate disputes, suspected fraud, or violations of these Terms.

8.5. Payment Processing

Payments on the Platform are processed by third-party payment providers, including Stripe. By using Cardarro to receive payments as a seller, you agree to be bound by the Stripe Connected Account Agreement, available at https://stripe.com/connect-account/legal. You also agree to comply with the Stripe Services Agreement and any applicable payment processor requirements.

8.6. Taxes

Applicable sales taxes may be calculated and collected during checkout in accordance with applicable laws.

Tax calculation and collection may be facilitated by third-party service providers, including Stripe.

Buyers are responsible for paying any applicable taxes associated with their purchases. Sellers are responsible for complying with any tax obligations applicable to their sales.

9. Buyer Protection & Disputes

Cardarro provides a limited buyer protection system to help resolve certain issues that may arise during transactions. After an order is confirmed as delivered, buyers have five (5) days to open a dispute if there is a problem with the order. If no dispute is opened within this period, the transaction will be considered completed.

9.1. Eligible Disputes

Buyers may open a dispute if one of the following situations occurs:

  • Item Not Received — The buyer did not receive the item associated with the order.
  • Significantly Not As Described (SNAD) — The item received materially differs from the description or images provided in the listing.
  • Damaged in Transit — The item arrived damaged during shipping.
  • Wrong Item Received — The buyer received an item that does not match the order.

Cardarro may request supporting documentation, including photographs, shipping records, or additional information to evaluate the dispute.

9.2. Non-Eligible Disputes

The following situations are not eligible for disputes under the buyer protection system:

  • Buyer's remorse or change of mind
  • Price dissatisfaction after purchase
  • Minor cosmetic differences that were reasonably visible in listing photographs
  • Issues raised after the buyer protection period has expired

9.3. Dispute Resolution

When a dispute is opened, Cardarro may review the available evidence from both the buyer and the seller. Cardarro may request additional information from either party in order to evaluate the situation. Based on the available information, Cardarro may take actions including:

  • Issuing a refund to the buyer
  • Releasing funds to the seller
  • Requesting additional resolution steps between the parties

9.4. Platform Authority

Cardarro reserves the right to make the final determination regarding disputes. Users agree to cooperate with reasonable requests during the dispute investigation process. Failure to cooperate may result in the dispute being resolved based on the available information.

10. Prohibited Conduct

Users of the Platform agree not to engage in activities that violate these Terms or that undermine the safety and integrity of the marketplace. Prohibited activities include, but are not limited to:

  • Listing counterfeit, fake, or unauthorized items
  • Selling proxy cards intended to imitate authentic products
  • Providing false or misleading listing information
  • Using stock images or images that do not depict the actual item being sold
  • Attempting to manipulate listings, pricing, or marketplace activity
  • Engaging in fraud, scams, or deceptive practices
  • Attempting to bypass the Platform to complete transactions outside of Cardarro
  • Harassing, threatening, or abusing other users
  • Using the Platform for unlawful purposes
  • Attempting to gain unauthorized access to the Platform or other user accounts

10.1. Platform Integrity

Users may not attempt to interfere with the operation of the Platform, including:

  • Circumventing security measures
  • Using automated systems to manipulate listings or activity
  • Attempting to exploit vulnerabilities in the Platform

10.2. Enforcement

If Cardarro determines that a user has violated these Terms, it may take enforcement actions including:

  • Removing listings
  • Cancelling transactions
  • Restricting account functionality
  • Suspending or terminating accounts

Cardarro reserves the right to take enforcement action at its sole discretion in order to protect the Platform and its users.

11. Intellectual Property

All content and materials available on the Cardarro Platform, including but not limited to text, graphics, logos, software, interface design, and trademarks, are owned by or licensed to Cardarro and are protected by applicable intellectual property laws. Users may not copy, reproduce, distribute, modify, or create derivative works from any portion of the Platform without prior written permission from Cardarro.

11.1. User Content

Users may upload content to the Platform, including listing descriptions, photographs, and other materials ("User Content"). By submitting User Content to the Platform, you grant Cardarro a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and publish such content for the purposes of operating, promoting, and improving the Platform. This license allows Cardarro to display listings, show images in search results, and use marketplace content in promotional or informational materials related to the Platform.

11.2. Responsibility for User Content

Users are solely responsible for the content they upload to the Platform. By submitting User Content, you represent and warrant that:

  • You own the rights to the content or have permission to use it
  • The content does not violate any intellectual property rights or laws
  • The content accurately represents the item being sold

Cardarro reserves the right to remove content that violates these Terms.

12. Disclaimers

The Cardarro Platform is provided on an "as is" and "as available" basis. Cardarro makes no warranties or representations regarding the reliability, availability, or accuracy of the Platform or any content provided through it. Cardarro does not guarantee:

  • The authenticity, legality, or condition of items listed by users
  • That listings are accurate or free from errors
  • That the Platform will operate without interruption or technical issues

To the fullest extent permitted by law, Cardarro disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.1. Collectible Value Disclaimer

Items sold on the Platform may fluctuate in market value over time.

Cardarro does not guarantee the investment value, resale value, or market price of any item listed or sold on the Platform.

13. Limitation of Liability

To the fullest extent permitted by law, Cardarro, LLC, its owners, officers, employees, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the Platform. This includes, but is not limited to, damages related to:

  • Transactions between buyers and sellers
  • Lost or damaged shipments
  • Misrepresented or counterfeit items
  • Payment disputes or chargebacks
  • Platform downtime or technical issues
  • Unauthorized account access

In no event shall the total liability of Cardarro, LLC arising out of or relating to these Terms or the use of the Platform exceed the greater of:

  • The amount paid by the user to Cardarro during the twelve (12) months preceding the claim, or
  • One hundred U.S. dollars ($100)

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, liability will be limited to the fullest extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Cardarro, LLC, its owners, officers, employees, affiliates, and service providers from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your listings, transactions, or interactions with other users
  • Any content you submit to the Platform

Cardarro reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you.

15. Suspension & Termination

Cardarro reserves the right to suspend, restrict, or terminate user accounts at its sole discretion if it determines that a user has violated these Terms or engaged in activity that threatens the safety or integrity of the Platform. Enforcement actions may include:

  • Removing listings
  • Cancelling transactions
  • Restricting account functionality
  • Disabling selling privileges
  • Suspending or terminating accounts

15.1. Restricted Accounts

If a user account is restricted or suspended, Cardarro may disable certain features of the account, including the ability to create listings or complete transactions. Users may still retain access to their account information for the purpose of reviewing orders, transaction history, or other records.

15.2. Termination

Cardarro may terminate accounts for serious violations of these Terms, including fraud, counterfeit listings, or abusive behavior toward other users. Users whose accounts are terminated may be prohibited from creating new accounts or accessing the Platform in the future.

16. Changes to Terms

Cardarro may update or modify these Terms from time to time. When changes are made, the updated Terms will be posted on the Platform with a revised effective date. Continued use of the Platform after updated Terms are posted constitutes acceptance of the revised Terms. If a user does not agree to the updated Terms, they must stop using the Platform.

17. Dispute Resolution & Arbitration

If a dispute arises between you and Cardarro, we encourage you to contact us first so we can attempt to resolve the issue informally. If a dispute cannot be resolved informally, it will be resolved through binding arbitration, rather than through court proceedings, except as otherwise provided in these Terms.

17.1. Arbitration Agreement

You and Cardarro agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be resolved through binding arbitration conducted in the United States. Arbitration will be administered by a recognized arbitration provider and conducted in accordance with applicable arbitration rules. Arbitration proceedings will be conducted on an individual basis.

17.2. Class Action Waiver

You and Cardarro agree that disputes will be resolved only on an individual basis, and not as part of a class action, consolidated action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cardarro.

17.3. Small Claims Exception

Either party may bring an individual claim in small claims court if the claim qualifies and remains within that court's jurisdiction.

18. Electronic Communications

By creating an account or using the Platform, you consent to receive communications from Cardarro electronically. These communications may include:

  • Account notifications
  • Transaction updates
  • Policy updates
  • Service announcements
  • Legal notices

Electronic communications may be delivered through email, Platform notifications, or other electronic means. You agree that all agreements, notices, disclosures, and communications provided electronically satisfy any legal requirement that such communications be in writing.

19. Governing Law

These Terms and any disputes arising out of or related to the use of the Platform shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles.
